Public offer agreement for access to the “NetSecret” service

This is a translation. The agreement is governed by the law of the Russian Federation and the Russian text is the only binding version. If anything in this translation differs from the Russian original, the Russian version prevails.

1. General provisions

Плательщик налога на профессиональный доход (самозанятый), taxpayer number (INN) 613701345604 (the “Provider”) publishes this document as a public offer addressed to any legally capable individual or legal entity (the “Customer”) pursuant to Article 437 of the Civil Code of the Russian Federation.

Paying for the service on the website netsecretnet.ru constitutes the Customer’s full and unconditional acceptance of this agreement (acceptance of the offer, Article 438 of the Civil Code of the Russian Federation).

2. Subject of the agreement

The Provider grants the Customer access to the “NetSecret” service based on the WireGuard protocol in accordance with the selected plan (“Start”, “Pro” or “Premium”), and the Customer pays for the service on the terms published in the “Plans” section of the website.

3. Payment and delivery of the service

  • payment is made through the Platega and YooKassa payment services@else the YooKassa payment service (bank cards, SBP instant transfers, cryptocurrency and other methods available in the payment interface);
  • after successful payment the WireGuard connection configuration is generated automatically and sent to the email address given by the Customer at checkout;
  • the subscription is valid for 30 (thirty) calendar days from the date of payment, unless the plan description states otherwise.

4. Rights and obligations of the parties

The Provider undertakes: to make connection to the service technically available in accordance with the parameters of the selected plan (speed, number of devices); not to keep logs of the Customer’s network activity.

The Customer undertakes: not to use the service to commit acts that are unlawful under the legislation of the Russian Federation; not to pass the configuration received to third parties for commercial use.

5. Refunds

Amounts paid are non-refundable except in cases expressly provided for by the legislation of the Russian Federation. A Customer who is a consumer — a natural person — has the right to withdraw from the agreement in the manner established by consumer protection legislation, reimbursing the Provider for costs actually incurred as at the date of withdrawal.

6. Liability of the parties

The Provider is not liable for:

  • temporary unavailability of the service for reasons beyond the Provider’s control (communication network failures, acts of third parties, force majeure);
  • inability to reach particular internet resources that restrict or block connections made through the “NetSecret” service;
  • actions taken by the Customer using the access provided.

7. Personal data

The Customer’s personal data is processed in accordance with the Personal Data Processing Policy, which forms an integral part of this agreement.

8. Dispute resolution

Disputes and disagreements are settled through negotiation, with a mandatory pre-litigation (claim) procedure. A claim is reviewed within 30 (thirty) calendar days of receipt. If no agreement is reached, the dispute is referred to a court in the manner established by the legislation of the Russian Federation.

9. Term and amendment of the agreement

The agreement takes effect upon acceptance (payment) and remains in force until the parties have fully performed their obligations. The Provider may unilaterally amend the terms of the offer; the current version is always available at https://netsecretnet.ru/offer.
